I have been accused of a sexual offence: what comes next?
As a highly experienced sexual offences barrister, I have seen many people wrongly accused of sexual offences for a wide variety of reasons. From rape accusations to those involving indecent images, I have helped many clients in very challenging circumstances to defend their cases and move forward with their lives.
Seek legal advice
If you have been accused of a sexual offence, you must contact a specialist sexual offences lawyer right away. The sooner you get in contact with me, the more opportunities we have to defend your case.
Do not try to resolve the situation yourself
This is easier said than done, I understand that this is a very tense time for you, and you may feel the need to ‘act’ in some way to protect yourself. However, you must not under any circumstances attempt to take matters into your own hands in the hope of resolving the situation.
If the complainant is a colleague, former partner, neighbour or friend, I understand why you might think you could settle the complaint by talking to them. However, you could jeopardise your case. There is a high risk the complainant will become scared or upset, and this could be very damaging to the case we are building.
Remain calm
Staying calm in the face of losing your job, your reputation and even your family may seem impossible, but it is essential to ensure the best outcome. If you have been wrongly accused of a sexual offence, I understand you may be angry, but you must avoid conflict with anyone else involved in the investigation. If you have to be in contact with a complainant or any witnesses, I would recommend that a third party is present to avoid any further allegations.
Do not attempt to interfere with the investigation
You must not interfere with any evidence which could be used during the investigation – even where you are entirely innocent. Destroying or hiding evidence which you believe makes you ‘look guilty’ raises suspicion. For example, if you have previously sent emails or messages to the complainant around the time of the alleged offence and you delete them when you know they may be necessary to the case.
In fact, before you take any action which may have an impact on your case, you should consult your lawyer.
Defending sexual offence accusations
Under the law, the onus is on the Crown to prove that you are guilty. While it can feel like you are fighting for your innocence, you are deemed to be innocent until proven guilty.
When it comes to being accused of a sexual offence, there are several scenarios which may apply to your circumstances.
Firstly, the allegations may be entirely false and even malicious. If this applies to your circumstances, I will work with you to break down these unfounded allegations gathering evidence to build a robust case for you.
Where you have been accused of rape or sexual assault, your case may turn on the issue of consent. Proving consent can be complicated, but I have exceptional experience in building a strong defence for my clients accused of sexual offences.
